Selected Cases (Partial List)

•Was lead counsel for a billion-dollar computer reseller in a trial against one of its distributors. Case was a basic breach of a UCC contract with a counterclaim for several million dollars. Defendant settled after the conclusion of our case by dismissing its cross-complaint and paying a multi-million dollar settlement.


•Was the lead counsel representing a computer reseller franchisor in a claim for breach of contract against one of its franchisee. Case settled favorably for a specific contract to purchase $55,000,000 in products from client.


•Was the lead counsel representing a computer reseller franchisor in a claim for breach of contract against one of its former franchisee. Case resolved favorably after a preliminary injunction was obtained requiring the defendant to deposit 15% of its monthly revenue in an account for the client’s benefit. Case settled for a contract requiring the defendant to purchase over $20,000,000 in product from client.


•Defended a large European company in a trial alleging breach of a share holders agreement. Agreement was governed by Hong Kong law which required substantial work with English common law and HK and UK barristers. Plaintiff sought $100,000,000 in actual damages. After two weeks of pretrial motions, the case settled favorably for less than the cost of defense.


•Assisted an automobile security system manufacturer obtain a preliminary injunction against a competitor for product disparagement and unfair business practices involving production and distribution of false videos at trade shows throughout the United States and Canada. The case settled by making the preliminary injunction permanent.


•Successfully tried a case for a tugboat company for breach of contract to sell a vessel. The jury not only rejected the plaintiff’s $3,000,000 claim; it also awarded our client $50,000 on its cross-claim. The client also recovered $100,000 in contractual attorneys’ fees.


•Successfully defended a manufacturer in an intellectual property and contract case brought by the inventor concerning acquired technology. The case involved copyright infringement, breach of contract, RICO and fraud claims. Case was dismissed by the federal court following a Rule 12(b) motion. Assignment also involved managing business aspects of the dispute, communication with the press and distributors and finally obtaining insurance coverage to pay the defense costs so that the client paid nothing.


•Successfully handled a series of cases for a manufacturer of engine equipment for alleged hearing loss. All cases have been dismissed either on statute of limitations of proximate cause grounds.


•Successfully represented an attorney in an arbitration of a law firm dissolution with the result that the client was relieved of over $150,000 in firm obligations.


•Successfully represented a computer manufacturer in a wrongful termination law­suit.


•Successfully enforced post-employment confidentiality covenants on behalf of employers in five jurisdictions.

•Obtained a substantial settlement for business interruption damages for a manufacturing client whose plant was destroyed in a chemical explosion.
